St. Petersburg, FL (LifeNews.com) -- The Terri Schiavo Story, a highly-regarded documentary on the life and euthanasia death of the disabled Florida woman, continues to rack up new awards. Meanwhile, the Schindler family continues to help disabled patients whose lives are threatened by doctors or families.
Schiavo was killed in a painful starvation and dehydration euthanasia death over the course of nearly two weeks when her former husband won a court order to kill her and the documentary presents facts that the mainstream media distorted.
Earlier this year the Terri Schiavo Story won the 2009 Jubilee Award at the San Antonio Independent Christian Film Festival.
Now, the film has won the 2009 Crown Award for Best Documentary at the ICVM conference (International Christian Visual Media).
In addition, the Dove Foundation, known for their high standards in family entertainment and their "Family Approved" Seal, has given "The Terri Schiavo Story" its highest rating of five stars.
Meanwhile, Bobby Schindler, Terri's brother, says the foundation he and his family created to help people like Terri is receiving a growing amount of calls for help.
"Over the past few months Terri's Foundation is experiencing a significant increase of calls from family members asking us for help in a variety of health care treatment situations," Schindler explained.
"Most of these are dealing with people who are facing withdrawal of medical care. These calls have been coming in from across the nation. This increase in calls is alarming," he said.
"These calls come in from everyday families who are faced with having their loved ones killed simply because they need extra care or have potentially life threatening disabilities," Schindler continued. "Sadly, too many in the medical community are now deciding that some people should die because their 'quality of life' does not meet some standard that is being subjectively established."
"Terri's Foundation fights every day for the families faced with these situations, trying to protect their loved ones from a strong euthanasia movement," he said.
Schindler says, in an email to LifeNews.com, that the health care bills pending in Congress could add to the concerns.
"And despite the warning from health care experts that a government controlled health care system will only add to this growing problem, potentially exposing countless of our most vulnerable in harm's way, we will remain committed to fight," Schindler said.
Schindler talked about the kind of ethic society needs to embrace.
"We believe no one is unworthy of life, and the most vulnerable among us deserve nothing less than our unconditional love, compassion and care," he said.

Florida Statues Prohibit Deliberate Acts to End Life
765.309 Florida Statute: Mercy Killing of Euthanasia Not Authorized; Suicide Distinguished. -- (1) Nothing in this chapter shall be construed to condone, authorize, or approve mercy killing or euthanasia, or to permit any affirmative or deliberate act of omission to end the life other than to permit the natural process of dying. (2) The withholding or withdrawal of life-prolonging procedures from a patient in accordance with any provision of this chapter does not, for any purpose, constitute a suicide.
458.326 Florida Statute: Intractable Pain; Authorized Treatment. -- (4) Nothing in this section shall be construed to condone, authorize, or approve mercy killing or euthanasia, and no treatment authorized by this section may be used for such purpose.
782.08 Florida Statute: Assisting Self-Murder. -- Every person deliberately assisting another in the commission of self-murder shall be guilty of manslaughter, a felony of the second degree, punishable as provided in s.775.082, s. 775.083 or s.775.084.
Florida's prohibitions against assisted suicide protects not only the terminally ill, but also the disabled, the elderly, the chronically ill, the severely handicapped.
Withholding food and water by mouth is a deliberate act to end life and is prohibited in the Florida statutes! "Helping" Terri kill herself is assisted suicide and is also prohibited in the Florida statutes.

Pinellas Park, FL (LifeNews.com) -- Terri Schiavo died a year ago today. She passed away after enduring 13 days of a painful starvation and dehydration death that six state and federal courts declined to prevent.
While her family still remembers a loving daughter and sister, her death was the beginning of a renewed debate about euthanasia and end of life issues.
Terri died on a Thursday morning at Woodside Hospice, and Paul O'Donnell, a Franciscan monk who had been a spokesman for the Schindlers during the two weeks of agony she endured, confirmed her death that fateful day.
"It is with great sadness that it's been reported to us that Terri Schiavo has passed away," he told reporters.
Terri's Medical Condition Very Serious Before Death
Earlier in the day, Terri's brother, Bobby, saw her the most in her last 48 hours, described her as "very gaunt" in a morning visit and noted that her medical condition deteriorated rapidly the night before.
"It's her 14th day without food and water. You can imagine, it is not a pretty sight," he said shortly before her death.
Terri's parents, Bob and Mary Schindler, Bobby and sister Suzanne Vitadamo were in Terri's hospice room visiting with her until about 10 minutes before she died.
Father Frank Pavone of Priests for Life visited Terri Thursday morning with her family. He said Bobby and Suzanne were ''sitting there praying, holding her hand, stroking her hair."
Michael Told Terri's Family to Leave
Although Terri's parents and family were with her 10 minutes before she died, Terri's estranged husband Michael prevented them from being with her at the moment of her death.
O'Donnell indicated that, at the end of their scheduled one hour visit, police instructed them to leave.
"At that point, they pleaded with the police -- the police were acting under the orders of Michael Schiavo - that Michael allow them to stay in the room as Terri was about to pass away," O'Donnell said.
The Schindler family agreed to be in the room at the same time as Michael, if that would persuade him to let them stay. Police passed on the plea to Michael, who denied it and instructed police to threaten them with arrest if they did not comply with his wishes to leave.
"They not only escorted them out of the room, but also off the hospice property. Within ten minutes, it was reported that Terri passed away," O'Donnell said.
Terri Tried to Say She Wanted to Live
Almost a week before her death, Terri tried to tell a family attorney that she wanted to live.
Barbara Weller, one of the attorneys for Terri's parents, told the disabled woman, "Terri, if you would just say, 'I want to live,' all of this will be over."
Weller said Terri desperately tried to repeat Weller's words.
"'I waaaaannt ...,' Schiavo said. Weller described it as a prolonged yell that was loud enough that police stationed nearby entered the hospice room.
"She just started yelling, 'I waaaannt, I waaaannt,'" Weller explained.
Terri Responsive Until Death, Prayed With Family
In one of the more remarkable evidences that Terri was responsive and interacting with her family, a Catholic priest who prayed with the Schindler's before Terri's death said the disabled woman closed her eyes for the prayer and opened them when it was complete.
"She was very responsive -- closing her eyes when I said, 'Let's pray together, Terri,' opening them up after the prayer," Father Pavone said.
He indicated Terri was smiling and "returning the kiss of her father" as well as "turning her eyes to me when I spoke to her."
Terri Never Wanted to Die
Though her former husband Michael alleged Terri told him numerous times she didn't want any extra measures taken to keep her alive, a close friend of Terri's disputes that claim.
Diane Meyer told the courts that Terri never would have wanted to die this way.
After viewing a documentary on Karen Quinlan, another disabled patient who was the center of a national euthanasia debate, Terri said courts and doctors wouldn't know what Karen wanted.
"Where there's life, there's hope" Terri told her friend.
Neurologists: Terri Wasn't PVS
Before her death, two leading neurologists said Terri was not in a persistent vegetative state.Dr. Joseph Fins of New York Presbyterian Hospital/Weill Cornell Medical Center reviewed Schiavo's medical records for the Florida Department of Children and Familles.
Fins indicated Terri's condition may have been misdiagnosed and that she was more likely in a state of minimal consciousness rather than a PVS patient as courts and many media outlets alleged.
Dr. William Cheshire of the Mayo Clinic in Jacksonville, also believed Terri was minimally conscious rather than a PVS patient.
Media Anticipated Terri's Death
CBS News came under fire for prewriting and posting to its news web site a story claiming Terri Schiavo had died -- three days before her death.
"Surrounded by stuffed animals and medical equipment in her small hospice room in Pinellas Park, Fla., Theresa Marie Schindler Schiavo died," the pre-written story said.CBS News spokeswoman Sandy Genelius told LifeNews.com that the story was "a draft that was stored on the web site" but not intended to be accessible to the public. She said the story was accidentally saved to a portion of the web site accessible to search engines and she told LifeNews.com that CBS News "removed the story as soon as the error was discovered."
Courts Refused to Stop Terri's Euthanasia Death
Circuit Court Judge George Greer initially ordered Terri's death in 2000 and her feeding tube was removed twice before. The second time, Florida Governor Jeb Bush lobbied state lawmakers to pass a bill that would allow him to protect Terri's life.
They did, but the bill was ultimately declared unconstitutional.
During the third time Terri's feeding tube was removed, Congress passed legislation to protect Terri and the measure received President George W. Bush's approval.
However, three Florida and six federal courts ignored the bill's mandate to halt Terri's starvation and hold new trials related to the Schindlers' lawsuit.Related web sites:

Is it true that the Schindlers displayed to the public only the highly edited 4+minute of the 4+hours of videos?
Is it true that the Schindlers made these highly edited videos to give a false display of Terri Schiavo’s condition? Also proving the Schindlers knew the true condition of Terri Schiavo for them to even make these edited videos.
Is it true that the Schindlers’ overall purpose of these highly edited videos of Terri Schiavo was to incite sympathy, to generate donations and stir support?
These are the same videos that Bill Frist the ex-Senate Republician majority leader and physician made his famous mis-diagnosis of Terri Schiavo. The fraud worked on Frist.
Is it true that the Schindlers made request for donations for their legal fees?
Is it true that the Schindlers' legal representation was paid for by other rich foundations.
Is it true that the Schindlers (Bob Sr., Mary, Bob Jr., and Suzanne) are working for the Foundations that was/is financed with the requested “Legal Fees” donations which is still providing all four of them their livelihoods and retirements.
By requesting donations for one purpose (legal fees) and using these donations for another purposes (livelihoods and retirements) is a scam. It was a fraud on the persons that gave donations for the purpose of helping the Schindlers’ with their legal fees.
I called it a fraud especially on the public and/or their donors.
Everything the Schindlers state about Terri Schiavo’s condition is base on these edited 4+minutes of videos. Once the public realize that these videos were edited and staged to give a false display of Terri Schiavo's condition, The Schindlers' whole story line falls apart. The Pinellas County Medical Examiner’s autopsy report proves and disagrees with the Schindlers’ falsehoods about Terri Schiavo’s PVS.
The Schindlers are attempting to re-write the History of the Terri Schiavo Tragedy to fit their story line ("The Schindler Script").
It is true that Terri Schaivo’s condition was Persistent Vegetative State (PVS).
New Question about current events:
Is it true that the Schindlers are using Joni as a front person for the sale of their “The Terri Schiavo Story” DVDs to avoid any problems with the IRS and their 501(c)3 Non-Profit Charity Corp.? It could be a problem if the Schindlers have any financial gains from selling the videos.

Now, people are allowing Terri to rest and peace. One of the ways of achieving that goal is education about end of life issues and not promoting starving innocent human beings to death. Terri Schiavo did not starve to death. The ME report was explicitly clear on that issue. One also needs to bear in mind that laws and rules which apply to most situations may or may NOT apply to medical scenarios. The legal and ethical zeitgeist is distinct in such scenarios.
ReplyDeleteFor instance, Tim raises a good point that killing a person is illegal. That is true in most cases. But so is committing assault and battery and torture against a person. Still, stopping the artificial nutrition and hydration in Terri's case was not murder or manslaughter, for the same reason that implementing it in the first place and then maintaining it was not assault and battery.
One cannot glibly ignore the medical, ethical, and legal considerations. There is a reason people have to study 3 years to become a lawyer and 4 years to become a doctor. Simply knowing legal and medical facts is insufficient. One has to be able to interpret such facts in their correct context, knowing when they do and do not apply.
She did starve to death. The authorities withdrawn her food supply.

Judge Greer overstepped his power and Lisa Ruby have tons of links validating that premise. ReplyDeleteShe did NOT starve to death. Read the ME report. Her fat stores were intact, ergo she did not starve to death. The proximate mechanism of death was dehydration. This is distinct from starvation.
ReplyDeleteThe links you provide are not applicable in cases where a person has a fatal pathology and has declined life sustaining interventions. In point of fact, one could make the argument that keeping Terri on the tube feeds was violative, according to your links. But as I said, the links you provided simply are inapplicable. You obviously have no legal or medical training. Statuory, case, and common law need to be properly interpreted and applied.
You may want to read the Physicians' Ethics Manual, 5th edition, which was published in the Annals of Internal Medicine in April 2005. This manual is endorsed by the American Medical Association and the American College of Physicians. It deals specifically with medical scenarios.
You may also be interested in reading an article published in Neurology (a peer reviewed medical journal) in September of 2008. It actually quantified the amount of misinformation and disinformation associated with the former Schiavo case.

The right to "choose or refuse medical treatment" and to make "all medical choices" is part of Florida's constitutional right of privacy. All persons have this right whether competent or incompetent. Any treatment, including life prolonging procedures, can be withdrawn at any time, regardless of terminal illness, imminent death or incapacity. The withdrawal of life prolonging procedures, such as artificial feeding, does not cause death, it only allows death from natural causes. If a patient will die within 4 to 9 days after withdrawal of artificial feeding, then the condition is terminal and death is imminent. A patient who has orally or in writing expressed wishes for future health care can have those wishes implemented by a surrogate without judicial review; and a proxy appointed in writing may make all such decisions unless limited in the writing; in these two cases, any interested party who disagrees with the decision may take the matter to court. Written instructions are prima facie valid, oral ones must be proven by clear and convincing evidence.

(a) The patient does not have a reasonable medical probability of recovering capacity so that the right could be exercised by the patient.
(b) The patient has an end-stage condition, the patient is in a persistent vegetative state, or the patient's physical condition is terminal.

It was not a assumption or an error on Michael Schiavo’s part, it was the findings of a Florida Probate Court after viewing the evidence and hearing the testimony of three witnesses stating Terri Schiavo made the remarks that she would never wish to be kept in a unrecoverable condition that prevent her from living a normal functioning life. Terri Schiavo was in a Persistent Vegetative State, which was not recoverable, and she was not living a normal functioning life. Terri Schiavo could not perform any tasks or functions for herself and she could not communicate. Terri Schiavo’s persona was gone and her body was being kept alive by man’s medical technology.

Have you notice that Bobby Schindler Jr. has to be always introduced as “the brother of Terri Schiavo?” The Schindlers do not have name recognition with Terri Schiavo. That is why they named their foundation the Terri Schindler Schiavo Foundation and always refer to Terri Schiavo (her legal name Theresa Marie Schiavo) as Terri Schindler Schiavo. Otherwise no one would know any of the Schindlers claim to fame and send send them their donations.

In point of fact, one could make the argument that keeping Terri on the tube feeds was violative, according to your links. But as I said, the links you provided simply are inapplicable. You obviously have no legal or medical training. Statuory, case, and common law need to be properly interpreted and applied.
You may want to read the Physicians' Ethics Manual, 5th edition, which was published in the Annals of Internal Medicine in April 2005. This manual is endorsed by the American Medical Association and the American College of Physicians. It deals specifically with medical scenarios.
Response: Judge Greer withhold hydration and nutrition. That alone equates starvation since you're unnaturally witholding nutrients from the human body. Terri Schiavo never created a legally binding document will at all. People have every right to comment on subject regardless if they have extensive legal or medical training. The answer lies not so much within Schiavo's brain as in the minds of those who observe her.
As social beings, humans are hard-wired to examine another's face for clues to what the person behind it is thinking. They naturally associate vocal tones with specific moods. They detect meaningful words in nonsense utterances.

The Schiavo autopsy results, which clearly show the unfortunate Ms. Schiavo's brain to be half the normal adult size due to atrophy and deterioration, were released today to much media bruhaha.
An autopsy on Terri Schiavo, the severely brain damaged woman whose death sparked an intense debate over a person's right-to-die, showed that her brain was severely "atrophied," weighed less than half of what it should have, and that no treatment could have reversed the damage.
During a televised news conference in Largo, Fla., the Piniellas-Pasco Medical Examiner, Jon Thogmartin, also said the autopsy showed that Ms. Schiavo's condition was "consistent" with a person in a persistent vegetative state. That point had become a key issue in the debate over whether to prolong Ms. Schiavo's life and whether she had a chance to recover normal brain function.

During Terri Schiavo’s final days, when her fervent supporters said she was alert, responsive and trying to speak, she was massively and irreversibly brain-damaged, blind and oblivious to what surrounded her, a medical examiner’s findings revealed Wednesday.
Schiavo died March 31 at a Pinellas Park, Fla., hospice after the plastic tube through which she had received food and water for 15 years was removed by a Florida judge’s order, sought by her husband, who contended that she was in a persistent vegetative state.
Schiavo died of dehydration, said Dr. Jon R. Thogmartin, the chief medical examiner for Pinellas and Pasco counties, who announced the results of the autopsy at a news conference in Largo, Fla.
A battle over whether the Florida woman should be allowed to die had raged in Congress, the Florida Legislature and the state and federal courts, and President Bush signed a special law meant to help Schiavo’s parents keep her alive.

ReplyDeleteThere is a perpetual question / argument about whether Terri Schiavo was in a Persistent Vegetative State (PVS). In Terri’s case the question is irrelevant to the controversy.
On this forum there have been many postings of URLs of legal documents and articles by professionals of medically proven facts that Terri Schiavo was not going to recover from her condition. The point has been forgotten and/or distracted from that Terri Schiavo made statements to five individuals that she would not desire to be kept alive in an unrecoverable condition.
Terri’s statements were ruled in probate court as an VIRTUAL (verbible) LIVING WILL.
Any other statements in contradiction to this fact are attempted distractions or made by someone with no knowledge of the proven facts, laws and the Constitutional rights of each person.
I'm not stupid , so your ad hominem attacks outlines your character. I know the exceptions of First Amendment. These opposing viewpoints on Terri Schiavo hardly qualify as defamation or libel. Whatever your issue is with the person you keep attacking, take it to email or phone. No matter what they answer, you'd never be satisified because you clearly refuse to accept the truth. How juvenile and unbalanced you are to carry this on nearly five years later.

Utterly false. Terri's parents arrived 20 minutes after she died. They were not there at the time.
Her siblings and Father Pavone had visited for an hour and 45 minutes before the staff asked them to leave for a few minutes so they could check her vitals and attend to her personal needs (which probably included a diaper change and positioning). Bobby fought with the nurses and security in the room and the hallway having a sh*t fit. Of course he wasn't allowed back in.
BTW, Timothy, a word to the wise, don't use any of June Maxim's articles. She has a real thing about people 'stealing' her work and copyright infringement.

How did we get it wrong? We know what blinded her. But what blinded us?
Again, the bigger story is what you can't see. In this case, it's the four-plus hours of video from which Schiavo's parents and their supporters selected clips like these. Reporters who have watched the whole video series say it's largely a wasteland. "For nearly an hour, her parents and the doctor tell her to open her eyes, close her eyes, look this way, look that way—with little apparent response," says the St. Petersburg Times.
This is what happens when you deny reality. First you lose your senses, then your mind, then your soul.
